General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern the purchase of products offered on the website almara.es, in accordance with Spanish Royal Legislative Decree 1/2007 (Consolidated Text of the General Law for the Defence of Consumers and Users, TRLGDCU), Law 34/2002 on Information Society Services (LSSI-CE), and Directive 2011/83/EU on consumer rights.

2. Products and prices

All prices published on almara.es include applicable VAT (Art. 60 TRLGDCU) and are shown in euros (EUR). Shipping costs, where applicable, will be clearly itemised before the consumer confirms the order.

ALMARA reserves the right to modify prices at any time, although confirmed orders will remain subject to the price in force at the time of purchase. Product images are for illustrative purposes; minor variations in colour or texture may exist due to the handcrafted nature of the pieces.

3. Purchase process and contract formation

The purchase process on almara.es follows these steps:

  1. Select the product and add it to the cart.
  2. Review the cart and proceed to checkout.
  3. Enter shipping and billing details.
  4. Select payment method and confirm the order.
  5. Receive an order confirmation email.

The sales contract is formalised at the moment ALMARA sends the consumer an order confirmation by email (Art. 98 TRLGDCU). ALMARA reserves the right not to accept an order in the event of a pricing error, out-of-stock situation or exceptional circumstances, informing the consumer immediately and issuing a full refund if payment has already been made.

4. Payment methods

ALMARA accepts the following payment methods:

  • Credit or debit card (Visa, Mastercard, American Express) via Stripe, a PCI DSS Level 1 certified platform.
  • Other methods available at checkout (Apple Pay, Google Pay) subject to availability.

Payment is charged at the time of order confirmation. ALMARA does not store your card details under any circumstances. All financial information is managed directly by Stripe under TLS/SSL encryption.

5. Shipping and delivery

ALMARA ships to mainland Spain and the islands, and to selected European Union countries. Estimated delivery times are:

  • Mainland Spain: 2-5 business days.
  • Canary Islands, Balearic Islands, Ceuta and Melilla: 4-8 business days (special VAT or IGIC may apply).
  • Rest of Europe: 5-10 business days.
The maximum delivery period is 30 calendar days from order confirmation (Art. 109 TRLGDCU). If ALMARA is unable to meet this deadline, the consumer will be informed and may cancel the contract with a full refund.

Free shipping will be applied when the order amount exceeds the threshold indicated in the store. In any case, the final shipping cost will be shown itemised before confirming payment.

6. Right of withdrawal

As a consumer, you have the right to withdraw from the purchase contract within 14 calendar days without giving any reason (Art. 71 TRLGDCU), counted from the day on which you or a third party designated by you, other than the carrier, takes physical possession of the product.
To exercise the right of withdrawal you must notify us of your decision through an unequivocal statement (for example, by email to hola@almara.es) before the deadline expires. You may use the model withdrawal form in Annex B of the TRLGDCU, although this is not mandatory.

Exceptions to the right of withdrawal (Art. 103 TRLGDCU):

  • Personalised or bespoke products made to the consumer's specifications.
  • Products liable to deteriorate or expire rapidly.
  • Sealed products that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.

7. Returns and refunds

If you exercise the right of withdrawal, you have 14 additional calendar days from notification to return the product. ALMARA will refund the full order amount, including the original shipping costs (unless you chose a more expensive shipping option than the standard one), within a maximum of 14 days from when ALMARA receives the product or you provide proof of return (Art. 76 TRLGDCU).
The refund will be made using the same payment method used for the purchase. Direct return costs are borne by the consumer, unless the product has a defect or damage attributable to ALMARA.
To initiate a return, write to us at hola@almara.es stating your order number and the reason.

8. Legal product guarantee

All products sold on almara.es are covered by the 3-year legal conformity guarantee for new products, in accordance with Royal Decree-Law 7/2021 of 27 April, which transposes Directive (EU) 2019/771 on contracts for the sale of goods.

If the product does not conform to the contract, you are entitled to:

  • Repair or replacement of the product (at the consumer's choice).
  • Price reduction or contract termination, if repair or replacement is not possible or is not carried out within a reasonable time.
To claim under the guarantee, contact us at hola@almara.es stating the order number, description of the defect and, if possible, photographs of it.

9. Dispute resolution

In the event of a dispute, you may refer to the Consumer Arbitration Board of your autonomous community or file a complaint with the Spanish Consumer Agency (AECOSAN).
Furthermore, in accordance with Regulation (EU) No 524/2013, you may use the European Online Dispute Resolution (ODR) Platform to resolve disputes related to purchases made on almara.es:

10. Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by applicable Spanish legislation. For the resolution of any dispute arising from or related to these conditions, the parties submit to the Courts and Tribunals of the consumer's domicile, in accordance with the TRLGDCU and other consumer protection regulations.
